Public land and posted signs

Anyone else come across "no trespassing" signs placed in the wrong spot on public land? You look at the map and your GPS location, and you see actual government boundary markers in the correct place, but someone likes to think it's their corner of the woods. I did yesterday, but ended up seeing 2 toms and a hen off on private property...could have called them across the boundary into my lap, but the hen snuck up first and saw me 10 yards away. I just think it's funny the places some people post signs to try and keep people out of "their" woods.

I see it all the time, and tear them down when I see them. The worst is on private land where someone cheats the line. I'm in a major fight in Georgia because my neighbor ran his high fence :livid: 200 yards on me because the terrain was easier to run the fence. I politely took my truck and ripped it down using a tow strap. Now in a legal battle as I'm being sued for $750,000 destruction of property for the 1.5 miles of fence I destroyed.

The public land thing is infuriating because everyone's money paid for it, but some selfish jackass wants it all for themselves

What does your lawyer have to say about your defense in this matter?

He says I'm in the right, but depends on the judge. The big issue is I appatently didn't give him adequate time to remove it before tearing it down. I gave him 1 month, which I thought was more then enough. This neighbor and I have serious issues, same guy clear cut 250 acres a few years ago and paid me handsomely for it, but the mature oaks can't be replaced and are reverting back to sweet gum and red maple.
 
Holy cow! That's a whole'nother level of timber theft. Compensation aside, a 250 acre clearcut "mistake" has gotta be some sort of jail time if the ground is clearly posted.

He avoided that by paying double market value

It's America you can sue for anything these days, even stuff that makes no sense
 
Go out West and hunt... really bad out there with the way some outfitters post and claim public land for their clients.

This raises a lot of questions....sounds like it's fixing to be a good food fight. Are you going to have a jury decide it? Was there a property line fence up before he put up the high fence? Did he have a survey to support the new fence line? Did you hire a firm or a solo litigator?

Seems like people often go the big firm route for high dollar litigation...but the best litigators I've seen are in groups of 1-3 or so.

I'm honestly not trying to bash ot be a smart@ss.

How did they cut 250 acres without you noticing? Was it in an off season when you weren't around or something? I would have made him plant it back in pines at least.

No jury, just judge. No fence prior to the event, but the boundary was surveyed and clearly marked. His fence people ignored the survey line according to him, according to them he told them to stray across the line.

No worries.

I live here obviously, and usually from Mid-May until I plant plots in late Sept I stay completely away from the property. It's very isolated and remote and I like for things to be left alone during the heat of the summer. It's also a very large tract of land and keeping tabs on every corner is not the easiest. One other thing, this was cut in July-Aug and that time of the year temps soar into the 100's every day, and I prefer to not spend my days roasting like a turd in S. GA.

The soils aren't conducive for pines, and we already have enough pines. I wanted that area to stay as hardwoods for several reasons.

Same way that lady is suing starbucks for 5million dollars because her venti iced coffee doesnt have 16ozs in it because of the ice.

I hunt public land pretty much exclusively and also work for the forest service so I see it ALOT. Ive seen people hang purple private property flags thru the middle of the woods. Ive seen entire fenced in fields on forest service (5-10 acres) and ive hunted them. Ive been threatened by gun to get off "their" property which was actually a public trespass. Ive seen the no trespassing signs in the middle of the woods on public land. Ive had people cut trees down to block access to public roads. My personal favorite... Ive seen someone tear down a forest service road marker and place mail a mail box at the beginning of a fs road to trick people into thinking it was a private drive.
