I think this deer is 2-3 years old. I wouldn't pass him on the public I hunt. If he doesn't get you excited and you know he's gonna be there next year, I'd save him.
 
Here a few of my known 3.5s and they are leaner and higher in the hip and appear longer legged

I would give him a pass, at least until I felt confident he's 5 1/2 or older.
I've seen huge increases in mass from 4 1/2 to 5 1/2.
Oh Hes definitely safe. I care little about shooting them anymore, but i love to watch them grow and return. The killing part is no longer very important . However, im fascinated by the behavior and movement patterns of old deer
