Moonshine had been considered illegal in most part of Tennessee before 2010 when it was legal in only 3 counties. But, since 2010 it is legal in 44 counties provided that the manufacturer holds a license issued by the state (the Tennessee Code 2010 39-17-706). Unlicensed production of moonshine is considered to be a Class A misdemeanor.
Possession of still or any other apparatus for distilling moonshine is considered to be a Class B misdemeanor (The Tennessee Code 2010 39-17-707).
Distillation of moonshine in homes is not allowed without a license which subjects you to tax, but manufacture the of undistilled liquor up to 5 gallons is allowed in Tennessee provided that it is used for domestic use only (The Tennessee Code 39-17-708).

No. What is illegal is the process, ie. distillation, not alcohol content. Granted distillation will yield higher AC, but the process is what's illegal.

Yup, its a No-No under federal law. Its dumb, that we can legally make beer, wine cider etc...but not distill liquor but it is the law.
People will often say distilling illegal because its too dangerous. It really isn't any more dangerous than cooking with gas/propane. What really makes distilling dangerous is the fact that people who do it are forced to do it(illegally) in the woods or other place with less than optimal conditions/equipment. Deep frying food is probably more dangerous than distilling liquor with proper equipment/conditions. How many people burn themselves or burn down their homes every year deep frying turkeys?
Arguably(its a grey area) putting a low alcohol content bottle of booze or even a beer in the freezer is illegal since you are potentially increasing the alcohol content through concentration(sometimes referred to freeze distilling).
