It most likely wouldn't go to court. The vast majority of cases are plead out, which is just another reason why having them bring charges is important. You would contact the city or county. As far as the home owners, if they give permission then go for it. It would be risky unless you had permission ahead of time. But if I got permission from several surrounding landowners around the parcel I would given it a try.Being in law enforcement, who would one contact to retrieve a deer that crossed into "closed to hunting" city/county property? Or how reasonable is it to contact a dozen home owners to blood trail a deer through their yard, never mind shinning a flashlight in the middle of the night in that neighborhood is asking for trouble.
That .86 acres you would be hunting doesn't leave room for error.
